Terms of service.

These Terms of Service ("Terms") govern your access to and use of consuligence.com (the "Site"), operated by Consuligence ("Consuligence", "we", "us", or "our"). By accessing or using the Site, you agree to be bound by these Terms. If you do not agree, do not use the Site.

1. About us and scope

1.1 Consuligence is a registered digital marketing company providing marketing strategy and execution services.

1.2 Digital products (such as prompt playbooks) are sold separately through Consuligence Digital Studio at consuligence.digital and through third-party marketplaces. Purchases of those products are governed by the terms presented at the point of sale, not by these Terms.

1.3 These Terms apply to the Site only. Client service engagements are governed by clause 6.

2. Eligibility

The Site is intended for users who are at least 16 years old and for business audiences. By using the Site, you represent that you meet these requirements and that any information you submit is accurate.

3. Use of the Site

3.1 Permitted use. You may access and view the Site, and use its content, for your own informational and business-evaluation purposes.

3.2 Prohibited use. You agree not to: (a) use the Site for any unlawful purpose; (b) attempt to gain unauthorised access to the Site, its infrastructure, or related systems; (c) interfere with or disrupt the Site, including by introducing malware or imposing an unreasonable load; (d) scrape, harvest, or systematically extract content or data from the Site, whether manually or by automated means, except as permitted by a search engine's standard indexing; (e) misrepresent your identity or affiliation; or (f) use the Site to transmit unsolicited commercial communications.

3.3 We may suspend or restrict access to the Site at any time for maintenance, security, or any other reason, without notice.

4. Intellectual property

4.1 The Site and all of its content — including text, articles, graphics, logos, visual designs, page layouts, and code — are owned by or licensed to Consuligence and are protected by copyright, trademark, and other intellectual property laws.

4.2 "Consuligence", the Consuligence logo, and "Consuligence Digital Studio" are trade names and marks of Consuligence. Nothing in these Terms grants you any right to use them without our prior written consent.

4.3 Limited licence. You may view, download, and print pages from the Site for your own use. You may quote brief excerpts of our articles with clear attribution and a link to the source page. You may not otherwise reproduce, republish, distribute, or create derivative works from substantial portions of the Site's content without our prior written permission.

4.4 If you send us feedback or suggestions about the Site or our services, you grant us a non-exclusive, perpetual, royalty-free licence to use them without obligation to you.

5. Content and no professional advice

5.1 Content on the Site — including articles, frameworks, and commentary — is provided for general information only. It is not professional, legal, financial, or other advice for your specific circumstances, and you should not rely on it as such.

5.2 Marketing outcomes depend on many factors outside our control. Nothing on the Site constitutes a guarantee, promise, or prediction of results.

5.3 We make reasonable efforts to keep content accurate and current, but we do not warrant that it is complete, accurate, or up to date at all times.

6. Service engagements

Any services we provide to a client are governed exclusively by the proposal, statement of work, or services agreement agreed for that engagement (the "Engagement Agreement"). In the event of any conflict between these Terms and an Engagement Agreement, the Engagement Agreement prevails for that engagement. Submitting an enquiry through the Site does not create a client relationship or any obligation on either party to enter one.

7. Third-party services and links

The Site links to and integrates third-party services, including Calendly (scheduling), Netlify (hosting and forms), Google Fonts (font delivery), consuligence.digital, and Gumroad (product sales). Those services are operated by third parties under their own terms and privacy policies. We are not responsible for, and make no warranties regarding, third-party services, sites, or content.

8. Privacy

Our collection and use of personal information through the Site is described in our Privacy Policy, which forms part of these Terms by reference.

9. Disclaimers

THE SITE AND ITS CONTENT ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, CONSULIGENCE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION.

10. Limitation of liability

10.1 To the fullest extent permitted by law, Consuligence shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, business, goodwill, or data, arising out of or in connection with your use of (or inability to use) the Site, even if advised of the possibility of such damages.

10.2 To the fullest extent permitted by law, our total aggregate liability arising out of or in connection with the Site shall not exceed one hundred (100) US dollars or the equivalent in local currency.

10.3 Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable law, including liability for fraud or for death or personal injury caused by negligence.

11. Indemnity

You agree to indemnify and hold harmless Consuligence from and against claims, liabilities, damages, and reasonable expenses (including legal fees) arising out of your breach of these Terms or your misuse of the Site.

12. Changes to the Site and these Terms

We may modify the Site, and we may update these Terms from time to time. The current version, with its "Last updated" date, will always be posted on this page. Changes take effect when posted, and your continued use of the Site after posting constitutes acceptance. If you do not agree to updated Terms, stop using the Site.

13. Governing law and disputes

These Terms are governed by the laws of India, without regard to conflict-of-laws principles, and the courts of that jurisdiction shall have exclusive jurisdiction over disputes arising from these Terms or the Site — except that either party may seek injunctive relief in any competent court, and nothing in this clause deprives you of mandatory consumer protections of your country of residence where they apply.

14. General

14.1 Severability. If any provision of these Terms is held invalid or unenforceable, the remaining provisions remain in full force.

14.2 No waiver. Our failure to enforce any provision is not a waiver of our right to do so later.

14.3 Assignment. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.

14.4 Entire agreement. These Terms, together with the Privacy Policy, constitute the entire agreement between you and Consuligence regarding the Site, superseding any prior understandings on that subject.
